Bupa Aged Care Australia Victorian Enterprise Agreement 2017
Each enterprise agreement has an expiry date of up to four years after approval by the Fair Work Commission. Bupa provided indiscrinting evidence that this restructuring would reduce the administrative burden on employees in the new clinical care manager role and allow them to focus on home care. Southern Cross Care (Tas) and Mary`s Grange Staff Enterprise Agreement 2017 Under the standard clause and paragraph 7 of Bupa`s Enterprise Agreement, the employer must notify workers of the decision to introduce the substantial change when an employer has made a significant change in production, establishment, structure or technology in relation to its business and the change is expected to have a significant impact on the company`s workers. An employer is also required to discuss with workers the introduction of the amendment, its likely effect and the steps taken by an employer to avoid or mitigate the adverse effects of the amendment. The Australian Nursing and Midwifery Federation (Vic Branch) negotiates enterprise agreements for nearly 1900 yards in Victoria. These agreements describe the salaries and conditions of tens of thousands of nurses, midwives and staff and non-members. There are 250 agreements on Victorian ANMF members who are nurses, midwives and private caregivers for the elderly. These EEAs, which cover many jobs, usually expire after three or four years. Ben Motro, Special Counsel, and Emily Setter, Law Clerk, reflect the recent decision of the Australian Real Estate and Midwifery Federation against Bupa Aged Care Australia Pty Ltd FCA 1246, in which Justice O`Callaghan of the Federal Court of Justice ruled that the consultation clause contained in an employer`s enterprise agreement does not require consultation on matters that do not lead to a « major change of place of work ». The business negotiation process was initiated in the early 1990s by the Hawke/Keating Labor Government. It replaced the priority given to national wages and industrial bonuses, which helped to identify the wages and conditions of categories of workers.
The purpose and intent of enterprise bargaining was to obtain higher wages and better terms than the bonuses granted. The 37-day industrial campaign by Bupa members in 2017, including rolling strikes, remains unprecedented in Australia`s aged care sector. The measures taken by nurses and nurses enabled Bupa to improve its offer of a 2.1% wage increase and not to change a one-year contract to 11.25% over three years, plus additional payment, improved fees and improved employment procedures.
